Telecommunications Compliance Policy

This Policy describes the compliance obligations that apply to SimToNet virtual phone numbers, messaging, voice, and related services. It supplements our Terms of Service and Acceptable Use Policy.

1. Compliance Commitment

SimToNet is committed to lawful communications, accurate end-user information, protection of telecommunications networks, and prompt action against spam, fraud, phishing, traffic manipulation, impersonation, and other abuse. Customers must comply with the laws and rules of every country affected by their use, as well as requirements imposed by number providers, carriers, and telecommunications authorities.

2. Customer and End-User Verification

SimToNet may verify customers and actual end users before provisioning a number or at any time during service. Verification may be completed through email and may require legal name, date of birth, physical address, telephone number, government identification, proof of address, business registration, authorized-representative details, beneficial-owner information, website, intended use, and other supporting records.

Documents must be genuine, legible, current, and belong to the person or organization that will actually use the number. False, altered, borrowed, or misleading information is prohibited. SimToNet may request reverification when information changes, a document expires, risk increases, a provider requests it, or law requires it.

3. Intended-Use Review

Customers must truthfully describe how each number or group of numbers will be used, who will use it, expected traffic, affected countries, and whether communications are transactional, support-related, promotional, or otherwise regulated. A material change of use requires prior notice to SimToNet and may require renewed approval or documentation.

4. Country and Number Requirements

Numbering requirements differ by country, region, number type, and end-user type. A local address, identity document, business registration, proof of local presence, or specific use may be required. Customers must provide information requested for regulatory registrations, bundles, address assignments, audits, or carrier reviews and must promptly correct outdated information.

Availability in the portal does not guarantee that a customer qualifies for a number or that the number can be retained indefinitely. A regulator, carrier, or provider may reject an application, change capabilities, require additional information, replace a number, or withdraw a number. SimToNet may take corresponding action to remain compliant.

5. Messaging Consent and Recipient Rights

Before sending any message, the customer must obtain the recipient's consent required by the law and carrier rules that apply to the recipient, sender, content, and use case. Consent must be informed, specific, freely given, and documented where required. Purchased, rented, scraped, shared, or transferred consent is not acceptable.

Customers sending messages must:

  • identify the sender and purpose when required;
  • send only content and at the frequency covered by consent;
  • retain evidence showing when, where, how, and for what purpose consent was obtained;
  • provide required opt-out instructions and process recognized opt-out requests promptly;
  • maintain suppression records so opted-out recipients are not contacted again without new valid consent; and
  • comply with registration, sender-ID, campaign, template, and quiet-hour requirements.

6. Voice, Recording, and Caller Identity

Customers must obtain any consent required for automated calls, prerecorded messages, call recording, transcription, monitoring, or storage. Caller identity must be accurate and must not impersonate another person or organization. A number may not be used as caller ID unless the customer lawfully controls it and such use is permitted by the relevant provider and law.

7. Verification Codes and Account Access

SimToNet numbers may not be used to intercept another person's communications, obtain unauthorized access, defeat a third party's identity or eligibility controls, or create, verify, recover, or control accounts without authorization. Public or shared inboxes that expose private communications or verification codes are not permitted.

8. Resale, Transfer, and Third-Party Use

Customers may not resell, sublicense, transfer, share, or provide a SimToNet number, account, API key, or service to an undisclosed third party. If SimToNet expressly approves a customer to provide functionality to its own end users, that customer remains responsible for identifying those end users, communicating applicable rules, maintaining required records, and preventing and responding to their violations.

9. Monitoring and Risk Controls

SimToNet and its providers may use traffic patterns, usage volume, complaint rates, delivery results, account history, login and API activity, message or call information, risk indicators, and provider notices to protect networks and assess compliance. Reviews may be automated or manual. We may set country, number, account, API, velocity, spending, or traffic limits and may request supporting evidence at any time.

10. Complaints, Investigations, and Remediation

Customers must promptly cooperate with inquiries from SimToNet, providers, carriers, regulators, or law enforcement. This may include supplying proof of identity, consent, business relationship, message source, intended use, and corrective action. Customers must preserve relevant records and must not conceal, alter, or destroy evidence related to an active investigation.

SimToNet may quarantine a number, restrict traffic, revoke API access, require remediation, suspend service, terminate an account, or release a number. Immediate action may be taken when delay could expose a person, network, carrier, provider, or SimToNet to harm or legal risk.

11. Recordkeeping

Customers must retain verification records, consent evidence, opt-out records, campaign details, and other compliance records for the period required by applicable law, carrier rules, and the relevant use case. Records must be accurate and available for a legitimate compliance review.
